SEC and TIA discuss a direction to enhance rights protection for shareholders and investors

Bangkok, 15 December 2023 – The Securities and Exchange Commission (SEC) has met, discussed, and exchanged views with the Thai Investor Association (TIA) on the direction for enhancing rights protection for shareholders and investors, with an aim to reinforce credibility of the Thai capital market.

On 8 December, 2023, Mrs. Pornanong Budsaratragoon, SEC Secretary-General and the SEC management met with Mr. Yingyong Nilasena, TIA President, together with the committee and advisors of the association and the directors of TIA’s Shareholder Rights Protection Volunteer Club, and discussed the ways to enhance shareholder and investor rights protection in response to the changes in capital market ecosystem, including the issue of class action lawsuit.

“TIA is one of the market participants that has continuously played an important role in supporting the development and reinforcement of shareholder and investor rights protection. With regard to the class action lawsuit, the SEC is of the view that it will facilitate shareholders in their collective action lawsuits and help them attain justice more evidently and concretely. As the TIA is a shareholder of each and every listed company that committed to taking action in this front, the SEC therefore will definitely support the TIA, in terms of legal advice in relation to the SEC rules and regulations and disclosable information for a more efficient investor rights exercising process”, said the SEC Secretary-General.

The SEC has continuously supported the TIA in the following projects, (1) Annual General/Extraordinary Shareholders’ Meeting Assessment Project and (2) Annual General/Extraordinary Meeting Assessment Project for (2.1) unitholders of property/infrastructure funds and (2.2) unitholders of real estate investment trusts (REIT)/infrastructure trusts.
