The proposed amendments are grouped into six key areas as follows:
(1) Digital Capital Market Promotion: updating legal frameworks to fully support electronic processes in the capital market and introducing provisions for Digital Infrastructure Main Operator;
(2) Supervision of Securities and Derivatives Business Operators: revising regulations for major shareholders of business operators and adding oversight provisions related to the personnel in securities and derivatives businesses;
(3) Supervision of Securities Market and Related Institutions: revising provisions related to the over-the-counter center in order to reduce barriers to establishment and operation, imposing regulatory measures to enhance the supervisory efficiency of the Stock Exchange of Thailand and introducing provisions regarding investment in securities by securities business related associations;
(4) Corporate finance Regulations and Audit firm and Capital Market Professional Supervision: revising regulations on debt instrument issuance and takeover activities and enhancing oversight of audit firms and capital market professionals;
(5) Enhancement of Law Enforcement and Penalty: vesting SEC officers the power to conduct an inquiry into certain criminal offenses that may seriously undermine trust and confidence in the capital market or national economic system and aligning penalty measures with Section 77 of the Constitution B.E. 2560 (2017) and the Act on Imposition of Pinai Regulatory Fines, B.E. 2565 (2022);
(6) Other Matters Related to SEC Administration.
