Supreme Court sentences former executive of listed company to imprisonment for seeking unlawful gains

? The Supreme Court of Thailand sentenced Kanchana Laowtrakul to a five-year imprisonment without probation for aiding and abetting Nuprapat Snidvongs Na Ayudhya in seeking unlawful gains from Seamico Securities Public Company Limited (ZMICO).

On December 29, 1999, the SEC filed a criminal complaint against Nuprapat, an ex-ZMICO director, on the charge of corporate fraud. Earlier, he had arranged for ZMICO to invest in shares of a listed company at the price not exceeding 20 baht per share which was very much higher than the market price at that time. He subsequently instructed Kanchana, an ex-ZMICO Senior Vice President, to acquire 172,400 shares of such listed company at 5.30-8.50 baht per share, on the Stock Exchange of Thailand through securities trading account of another person. Then, the shares were resold to ZMICO at 19.75 baht per share which was not the normal market price. Later, the public prosecutor issued a prosecution order and filed a lawsuit against Nuprapat and Kanchana with the Bangkok South Criminal Court.

The Bangkok South Criminal Court and the Appeal Court ruled against Nuprapat and Kanchana and sentenced them to a five-year imprisonment for violating the Securities and Exchange Act B.E. 2535 (1992) (SEA).

On February 21, 2015, the Supreme Court of Thailand sentenced Kanchana to a five-year imprisonment for violating Section 315 in conjunction with Section 311 of the SEA. Previously, the Supreme Court had dismissed Nuprapat case due to his death.
