SEC public hearing on draft amendments to private fund rules

Bangkok, 8 March 2019 ? The SEC is seeking public comments on the proposed amendments to the rules related to private fund (PF) management to promote flexibility in consistent with the increasingly diverse nature of the PF business, and maintain standards and quality of the business for the best interest of clients.

The SEC conducted an initial hearing on the principles for amending the PF rules in late 2018. Most stakeholders from the business sector and the mutual fund industry generally submitted positive responses supporting the principles.

The amendments drafted under the principle-based guidelines focus on four key areas, namely PF management, work systems, investment management and complaint handling. The objective is to facilitate flexibility and adjustment in line with the diverse nature of the PF business to replace the present fixed and detailed regulations. The scope of amendment includes, for example, corporate structure, personnel readiness, fees, investment management, prevention of conflicts of interest, internal control and receipt and delivery of fund assets.
