SEC to revise brokerage system rules as to facilitate application by the existing and new business operators

Bangkok, 11 May 2018 – SEC is seeking public comments on the proposed revision of rules on operating systems and service provision of securities companies and derivatives business operators to be more principle-based so as to facilitate application by the existing and new business operators.

SEC is proposing to codify and revise notifications prescribing rules on the operating systems and service provision of securities companies and derivatives business operators to be more appropriate and flexible but will mostly be based on the same principle. The revision will cover various systems for example, operating systems relating to organizational structure and personnel readiness, customer service and information system, internal control system, and risk management system. In addition, related notifications will be codified into one document to facilitate the business operators, such as notifications regarding handling of complaints or maintenance of capital/financial status.

SEC welcomes and will take into consideration more public comments which may be related to restrictions or obstacles in business operations in order to prescribe rules which are appropriate, practical and beneficial to stakeholders. This revision of notifications is not applicable to securities companies conducting mutual fund management and private fund management businesses.
