Bangkok, 10 August 2020 – SEC is seeking public comments on the proposed regulations for undertaking securities and derivatives businesses in the form of partnership to allow such business intermediaries to operate according to their proficiency and expertise and take responsibility only for the functions under their direct operation.
Pursuant to the existing regulations on standard conduct of business, a securities and derivatives business operator intending to have a third party handle its partial business functions may do so in the form of outsourcing or partnership. In this regard, the partnership-based business operation guidelines must be improved from the SEC circular in this matter.
SEC has therefore proposed issuance of clear-cut regulations to accommodate business operation and service provision in the form of partnership so that business operators will be able to run their business according to their expertise and take responsibility only for the functions undertaken by business operators themselves. This would allow SEC to supervise each business operator directly.
