Bangkok, Thursday 19 September 2019 - SEC is seeking public comments on the draft regulations relating to the net capital of securities and derivatives business operator, in order that the net capital will truly reflect the position of business operators without creating excessive burden on the business operators, and limit any potential damage to their clients and the overall capital market.
SEC plans to revise the criteria on the
maintenance of the net capital (NC) of securities and derivatives business
operator. SEC has, therefore, conducted a public hearing on this matter, in
principle, in the second quarter, covering the calculation of subordinated
facility for accommodating increasing transactions in the short-term, the
calculation of the capital to accommodate the digital asset business, and the
requirement that any business operator that cannot maintain its net capital to
meet the criteria must cease its business operation immediately in order to
prevent any damage to clients.
SEC
has drafted a regulations in accordance with the principles from the public
hearings, incorporating the suggestions of the business operators. In addition, SEC has revised the criteria for
the calculation of liabilities and risk haircut values in order that the
revised criteria will reflect the current situation concerning the debt
instruments business and promote debt instruments transactions in
Thailand.
