SEC public hearing on proposed extension to filing fee deduction timeframe and expansion of fee deduction scope for GHG emission data disclosure

Bangkok, 20 October 2023 – The Securities and Exchange Commission (SEC) is seeking public comments on the principles and draft regulations regarding (1) the extension of fee deduction timeframe for the filing of the registration statement and the annual registration statement for companies disclosing greenhouse gas emission data for three more years, and (2) the expansion of fee deduction scope to include consulting expenses for the preparation of carbon footprint disclosure. The proposed regulations aim to promote the business sector’s tangible consideration of environmental responsibility and reliable disclosure of greenhouse gas emission data.  


The SEC has implemented the initial intensive measures for securities public offering companies and listed companies that commission carbon footprint preparation reviewer in accordance with the Notification of the Office of the Securities and Exchange Commission No. Sor Mor. 18/2564 Re: Measures on Fee Deduction for Filing the Registration Statement for Securities Offering and the Annual Registration Statement for Companies Disclosing Greenhouse Gas Emission Data, dated 10 March 2021. The fee deduction measures will expire at the end of 2023.  

To render continuing support to the measures, the SEC is proposing to extend the deadline for filing the registration statement and the annual registration statement for companies disclosing greenhouse gas emission data and commissioning carbon footprint reviewers for three more years (2024-2026), and to expand the fee deduction scope to include consulting expenses for the preparation of carbon footprint disclosure.  

 
In this regard, the deductible amount would be actual expenses for engaging reviewers and / or consultants in the preparation of carbon footprint disclosure, but in any case not exceeding 50,000 baht per year.
