Bangkok, August 13, 2014 ? The SEC filed a criminal complaint with the Economic Crime Division of the Royal Thai Police (ECD Police) against G.O.L. (Thailand) Co., Ltd. and its director Jaray Chanchaisilp for operating unlicensed derivatives business.
Sakkarin Ruamrang, SEC Assistant Secretary-General, said that ?The SEC?s probe revealed that G.O.L. (Thailand) held itself out as gold futures trading agents. Without obtaining derivatives license from or being registered with the SEC, they advertised through various media channels including Facebook and solicited investing public to invest in gold in spot market, open trading accounts and trade through website www.goldexasia.com. It was, however, found that there was no gold delivery while payments were not made in full for trading transactions which were investment in gold futures, not spot gold. Accordingly, the actions of G.O.L. (Thailand) were in violation of the Derivatives Act B.E. 2546 (2003), Section 16, subject to sanctions under Section 125 of an imprisonment up to three years or a fine not exceeding 300,000 baht or both and a further fine not exceeding 10,000 baht for every day during which the violation continues. The SEC therefore filed a criminal complaint with the ECD Police against G.O.L. (Thailand) and Jaray. In this regard, the SEC encourages any person suffering damage from investment with the aforesaid persons to contact the ECD Police at 0-2237-1199 to reinforce further legal proceedings.?

Previously, on December 17, 2012, Jaray was also named in the criminal complaint on the same offense for being director of unlicensed businesses, namely Silver Line Trading Intertrade Co., Ltd. and Diamond and Silverline Group Co., Ltd. The case has been under the inquiry official?s consideration.
