SEC files criminal complaint against 4 TYM price manipulators

Bangkok, July 3, 2015 ? The SEC filed a criminal complaint with the Department of Special Investigation (DSI) against Sornnon Sudtiastasilp, Naraporn Chuvessiriporn, Nacharat Sirithep, and Thanatdej (Sudtiastasilp (or Jiraphoj Phatiphothiwat) for manipulating the share price of Thai Yuan Metal Plc. (TYM); presently known as The Steel Plc. (THE).

With the referral from the Stock Exchange of Thailand, the SEC probed into the case and found that during March 18 ? October 9, 2008, Sornnon, Naraporn, Nacharat and Thanatdej (or Jiraphoj) together with other 10 persons (one person died) colluded or agreed to trade TYM shares continuously through 9 securities trading accounts. They traded TYM shares in the manner that concealing, inflating and stabilizing the share price and matching orders within the group which caused   TYM share price inconsistent with normal market conditions to mislead the general public about TYM trading values and volumes and lure the general public to trade such shares.

Their actions were deemed manipulation of TYM share price in violation of Sections 243 in conjunction with Sections 244 and 243(2) of the Securities and Exchange Act B.E. 2535 (1992) (SEA) and Section 83 of the Penal Code. As the said four alleged offenders declined to enter the settlement procedure, the SEC therefore filed the criminal complaint against them with the DSI for further legal proceedings. 
In any case, the filing of a criminal complaint commences the criminal justice administration; whereby the court will judge the case accordingly.
