SEC orders EARTH to further clarify the B/E default

Thursday 8 June 2017 | No. 40 / 2017

Bangkok, 8 June 2017 ? With reference to Energy Earth Public Company Limited (EARTH)'s disclosure of the default on the bills of exchange (B/E) repayment to the Stock Exchange of Thailand (SET) in the evening of 7 June 2017, it has been found that the disclosure lacks sufficient details on the cause and effect of the default on other debts, EARTH's financial condition and operating results.

Since such material information could affect the benefits of securities holders, investment decisions and the EARTH securities price, the SEC has ordered EARTH to further clarify the cause of the default, relevant impacts and recovery plan, including the reason why the company failed to make necessary preparation in advance to avoid such default. EARTH's board of directors must clarify to the SEC and disclose the clarification through the SET Electronic Information System within seven days.

SEC Secretary-General Rapee Sucharitakul said: "Managing timely debt repayment is a serious matter. Earlier this year, the SEC urged short-term debt issuers to secure a reserve fund to prevent liquidity issues. In this particular case, the company must clarify information to investors to prevent damage to the overall credibility of listed companies.?
