SEC public hearing on proposed extension of scope of businesses under regulatory sandbox

Bangkok, 31 January 2020 – The SEC is seeking public comments on the draft proposal to extend the scope of businesses eligible to enroll in the Regulatory Sandbox for Capital Market Innovation Development Program to allow business operators equipped with innovations to test their services directly with customers.

Essentially, the draft proposal aims to allow three more types of businesses to participate in the Regulatory Sandbox to support more efficient provision of capital market services, namely: (1) securities brokerage, securities dealing, securities underwriting, mutual fund management and securities borrowing and lending (SBL) (currently only investment advisory and private fund management businesses are eligible for the program), (2) derivatives clearing house business, and (3) the securities trading center and derivatives trading center businesses.

In this regard, the related regulations on the preparation of projects for innovation testing and development would be amended to allow entrepreneurs with useful innovations to provide their products or services to customers under certain limitations. As a result of this proposed amendment, the Regulatory Sandbox would cover both pre-trading and post-trading activities in the capital market.
