Bangkok, 13 August 2019 - SEC is conducting a public hearing on the revision of the regulations concerning securities trading. SET Member and non-SET member securities firms will be able to trade listed securities outside the stock exchange through the Electronic Trading Platform (ETP) system for proper services.
As
SEC has made an amendment to Section 185 of the Securities and Exchange Act,
effective 17 April, the amended Section stipulates that SET-member securities
companies are able to trade listed securities outside the stock exchange if
abiding by the regulations, conditions and procedures set by the SEC Office.
Earlier, the law prohibited such companies to trade securities outside the
stock exchange with an exception for a SET permission.
Therefore,
SEC intends to revise the regulations on listed securities trading services outside
the stock exchange for proper supervision and in accordance with the amendment
to the Securities and Exchange Act. SET member and non-SET member securities
firms will be allowed to trade listed securities outside the stock exchange
only a case that trading is done with those receiving a license to provide
securities trading through the ETP or those receiving approval to participate
in the ETP Regulatory Sandbox scheme. This is because the ETP service providers
will have a duty to oversee proper securities trading. For example, information
must be disclosed before and after trading for investment decision-making,
trading must be regulated for smoothness and the settlement and delivery
systems must be efficient.
