SEC invites public comments on proposal to institute FETCO as juristic person

Bangkok, 29 October 2020 – The Securities and Exchange Commission (SEC) is seeking public comments on amending the Securities and Exchange Act B.E.2535 (1992) to institute the Federation of Thai Capital Market Organization (FETCO) as juristic person. FETCO, however, will continue its role to promote and support the development of the capital market business for sustainable growth.

SEC together with FETCO share a common view to enhance FETCO position to “The Capital Market Federation of Thailand” which would have legal status as a “juristic person” like other federations in the economic sector. Thus, FETCO will be able to bring more efficient cooperation with both public and private sectors.  

 

Under the proposed law, the structure of the Capital Market Federation of Thailand will be, among other things, as follows:

(1) it will be a juristic person under the Securities and Exchange Act; 

(2) its objectives will encompass promoting and supporting the development of the capital market business for sustainable, stable and efficient growth, enhancing the cooperation with organizations and entities involved with the capital market business, and performing other activities that would be beneficial to capital market business or consistent with its objectives upon permission from the SEC Board; and 

(3) Its governing body will consist of both ex-officio committee and committees elected by members. The board of committee will have duty to ensure that the administrations of the federation comply with its own by-law. The president of the committee will be the representative of the federation. And members of the Federation will comprise founding members and ordinary members.
