SEC public hearing on draft regulations related to services on privacy coins

Bangkok, 22 November 2021 – The Securities and Exchange Commission (SEC) is seeking public comments on the draft regulations related to provision of services on privacy coins* by digital asset business operators to ensure proper supervision of digital asset businesses and prevent misuse of digital assets as a tool for committing a crime.

Earlier on 5 August 2021, the SEC Board Meeting No. 14/2564 approved the proposal for amending the regulations related to supervision of digital asset business operators whereby digital asset business licensees would be prohibited from providing services related to privacy coins to prevent misuse of digital assets as a tool for committing a crime. 

After conducting a public hearing on the matter and taking into consideration the comments and recommendations of business operators and the general public, the SEC is now seeking public comments on two notifications concerning the proposed regulations for prohibiting digital asset business operators from providing services on privacy coins and the conduct rules for services on privacy coins provided prior to the effective date of the proposed regulations.

*Privacy coin means a digital asset having any of the following characteristics: 

(1)  Digital asset created with the objective of concealing information on the transferor, the transferee and the transfer volume; 

(2)  Digital asset created with the objective of specifying the right for the holder to control the concealment of information on the transferor, the transferee or the transfer volume.
